Terms of service

The agreement that covers your use of DevPulse, in plain language.

1. The agreement

These terms are an agreement between DevPulse ("we") and the organization or person using the service ("you"). By creating an account or using the service you accept them. If you accept on behalf of an organization, you confirm you're authorized to bind it.

An order form or enterprise agreement signed by both of us takes precedence over these terms where they conflict.

2. Your account

Keep your credentials secure and tell us promptly about any unauthorized use. You're responsible for what happens under your account, including actions by members and API clients you invite or create.

You must be at least 16 to use the service.

3. Your data

You own the data you and your applications send to the service ("Customer Data"). You give us permission to host, process and display it only to provide, secure and support the service, as described in the Privacy Policy and the Data Processing Addendum.

You're responsible for having the rights and consents needed to send us Customer Data, and for not sending special categories of personal data (health, biometric, and similar) unless we've agreed to it in writing.

You can export or delete Customer Data at any time. Deleting an organization deletes its Customer Data immediately; backups expire within 30 days.

4. Acceptable use

Don't use the service to break the law; to send spam or malware; to host phishing pages or content that infringes others' rights; to probe, scan or attack other systems; or to get around usage limits or access controls.

Don't use the webhook inspector, mock APIs, short links or status pages to impersonate other organizations or collect credentials.

Security research is welcome under the rules on our Security page.

We may suspend accounts that put the service or other customers at risk. Where we can, we'll tell you first and give you a chance to fix the problem.

5. Plans, payment and usage

Paid plans are billed in advance, monthly or yearly, per organization. Usage beyond a plan's included amounts is billed monthly in arrears at the prices on the pricing page, up to any spend cap you set.

Fees are non-refundable except where the law requires otherwise. Upgrades take effect immediately and are prorated. Downgrades and cancellations take effect at the end of the billing period.

We may change prices with at least 30 days' notice. Changes apply from your next billing period.

If a payment fails we'll retry it and notify you. Accounts that remain unpaid may be moved to the Free plan.

6. Availability and support

We work to keep the service available and publish its status. Uptime commitments and service credits apply only where an order form includes an SLA.

We may change or retire features. We'll give at least 90 days' notice before removing a material feature you pay for.

7. Confidentiality and security

Each of us will protect the other's confidential information with at least reasonable care and use it only to perform under these terms.

We maintain the security measures described on our Security page and in the Data Processing Addendum.

8. Warranties and liability

Except as expressly stated in these terms, the service is provided "as is", without warranties of any kind, to the extent the law allows.

Neither of us is liable for indirect, incidental, special or consequential damages, or for lost profits or data. Each party's total liability is limited to the amounts you paid us in the 12 months before the claim. These limits don't apply to your payment obligations, a breach of the acceptable use rules, or liability that can't be limited by law.

9. Ending the agreement

You can end the agreement at any time by deleting your organization from its settings, or your account from account settings. We may end these terms with 30 days' notice, or immediately if you materially breach them and don't fix the breach within 15 days of notice.

Sections 3, 7, 8 and 10 survive termination.

10. General

We may update these terms. We'll post the new version here, and give 30 days' notice by email of material changes.

If any part of these terms is unenforceable, the rest stays in effect. Neither party may assign this agreement without consent, except to a successor of its business.
